LAKE COUNTY, Chicago – The 70-year-old Lake Geneva, Wis. man accused to have embezzled money of about $800,000 from a Libertyville pain clinic is not unfit to stand for the trial, his attorney told a judge concerning to his client.

Attorney Jeffrey Rogers said John McCall suffers from a debilitating form of dementia, which is taking psychotropic medication, more often falls asleep and easily get confused, when the accused appeared in front of Judge George Bridges in a wheelchair.

“I have a difficult time just explaining the charges to him,” Rogers said. “At one point during our conversation he just fell asleep.”

McCall, who now lives with his son on the North Shore, once worked from 2001-2007, as a comptroller and debt collector at the Center for Pain Control, 1800 Hollister Drive, according to Lake County Assistant State’s Attorney Christen Bishop.

Aside from the salary McCall earned as a comptroller, he was also eligible to earn 30 percent of the outstanding debts he collected in addition to his salary, Bishop said. However, McCall and another suspect were being accused of taking 30 percent of all monies that came into the clinic, says Bishop.

McCall has been charged with theft without authority and theft by deception. He was due to be arraigned April 6, but Judge Bridges handed an order for a fitness evaluation to determine if he could be fit to stand for a trial.

Bridges will be expected to rule on the status of McCall’s fitness when both sides will appear in court on May 24 as scheduled.

Ricardo Huntley sentenced for stealing clients.

BARTOW, Florida – A two years on probation has been given to a former counselor for Polk County’s DUI/Drug Court after found guilty of stealing cash and items from clients.

Ricardo Huntley was also ordered to serve 180 days in a weekend work release program by a Circuit Judge Keith Spoto.

A conclusion has been made up by the State Attorney’s office after investigation that found Huntley stole clients who were trying to pay fees as part of the intervention and treatment program.

After his arrest on May 2009, more charges have been added on July 2010.

Huntley, 43, reached a plea deal with the prosecutors last month.

He pleads no contest to various charges that includes: official misconduct, tampering with a witness, uttering a forgery and grand theft and forgery.

On Wednesday’s hearing, through Huntley’s lawyer Karen Meeks, she stated that her client is remorseful and willing to pay $4,000 for total restitution.

There, she asked the judge to withhold adjudication for a formal finding of her client’s guilt.

Though he agreed, Spoto expresses displeasured to Huntley’s actions.

“I’m not going to do it because you deserve it,” Spoto said. “Frankly, you don’t deserve it.”

However, due to Huntley’s lack of prior criminal history, as well as the large amount of weekend release that Huntley must accomplish, the judge took into consideration of Huntley’s plea bargaining.

The court administrator for the 10th Judicial Circuit, Nick Sudzina, wrote a letter asking Huntley be guilty on adjudication.

“Mr Huntley was put in a position of public trust and made a conscious decision to violate that trust,” Sudzina wrote. “As a result, there were multiple victims that were harmed because of Mr Huntley’s conscious decision and the credibility of the Polk County Drug Court Program was jeopardized.”

San Antonio, Texas – The Texas Rangers and Bexar County sheriff’s deputies arrested 60-year old Ronnie Cain, who was the suburb’s chief administrative officer for 28 years before resigning in March, and his brother Gary, 53, at their homes on Thursday evening. The arrests came shortly after a Bexar County grand jury issued the multicount indictments. According to reports, an arrest warrant alleged the brothers “embezzled over $4 million” said Sheriff’s Office spokeswoman Linda Tomasini, quoting from the document.

Tomasini said, the men were being booked into Bexar County Jail in lieu of $250,000 bail each late Thursday. The sheriff’s spokeswoman said that Gary Cain began experiencing chest pains and was taken to University Hospital during the booking process. Their arrests is a result of nearly yearlong joint investigation by the Bexar County district attorney’s office and the Rangers, according to Cliff Herberg, first assistant district attorney.

The criminal investigation was the fallout of a civil lawsuit that alleged Gary Cain took $2.8 million fraudulently from a $5 million escrow account that Rackspace funded for infrastructure improvements. The fund was part of the deal in the city’s successful effort to lure the firm to the site of the former Windsor Park Mall. According to reports, Ronnie Cain suddenly announced he was retiring as the investigation heated up, but, he said the decision was not related to the investigation.

During April, Rangers and the DA’s office searched Gary Cain’s office, seizing documents, records and computer files. According to the affidavit allegations, Ronnie Cain had a sexual relationship with the former city secretary and described expensive gifts he gave the woman and that he used the fraudulently obtained money to buy jewelry and furniture as well as in taking “lavish trips” to Beverly Hills, New York and Puerto Rico. Herberg said Thursday that the evidence gathered in the April raid led to Thursday’s indictments.

The April search affidavit alleges Gary Cain fraudulently inflated those costs by more than $7 million, and that Ronnie Cain knew the true price paid for the land. The brothers are accused of pocketing the difference. “It’s alleged that the Cain brothers presented cost certificates to the Windcrest City Council as well as Rackspace that caused them to approve expenditures in excess of the cost actually paid for projects,” said Herberg. He also added in his statements that once criminal probe was launched, its focus broadened beyond a single transaction.

The former longtime Windcrest city manager and his developer brother were then charged on three felony counts Thursday. The brothers were each indicted on charges of misapplication by a fiduciary of more than $200,000, securing execution of a document by deception of more than $200,000, and theft of more than $200,000. Each is a first-degree felony, punishable by a term of up to life in prison. Ronnie Cain also was indicted on a charge of theft by a public servant of between $20,000 and $100,000, a second-degree felony punishable by up to 20 years. If convicted of the first-degree felonies, the brothers could land in prison for life.

BEAUMONT, Texas – Beaumont patrolmen soon to be carrying another tool to help fight criminality without firing their guns or using deadly force.

Beaumont City Council approved the 80 Tasers for purchase.

For 24 years in Beaumont Police Department service, Patrol Officer Dale Wisby knows the important of Taser. Each day of duty is different, and he never knew who or what he might be encounter.

“People are going to want something, need something. They’re gonna get injured or hurt, commit a crime, become a victim,” said Officer Wisby.

For helping other people, Officer Wisby enjoys his job. Sometimes he has to help people by force to get criminals under control.

“Guy didn’t want to go to jail, got to wresting and I injured my shoulder,” said Wisby.

Only if tools like Taser come in handy, Wisby said.

Every Beaumont patrol officer will have a Taser on his hip.

“When you use a Taser it reduces the need to use force that would injure a person,” said Police Chief Frank Coffin.

The 80 Tasers was proposed by Chief Coffin to the City Council, and will tap drug money confiscated by BPD to fund for the purchase.

Chief Coffin says, “We use drug money in areas that we don’t have budgetary funds to spend.”

“It will help lower the injuries to officers and injuries to citizens,” added Wisby .

The money taken off the street will turned into a tool, patrolmen like Dale WIsby will help fight crime.

32 Tasers will be used for about ten years when the department turn it over.

About $64,000 from the confiscated goods account the city will pay for the new Tasers.

CORRYVILLE, Ohio — The robbing at gunpoint of a student at the University of Cincinnati in Corryville early Friday is now being investigated by the authorities, according to Cincinnati police.

The university student was in the 2000 block of Vine Street near East University Street at around 2 a.m. when the gunman approached him from behind and at gunpoint, he demanded cash, a wallet, credit cards, and cell phone.

The 23-year-old student was not injured.

The suspect wore a camel-colored sweatshirt with green, yellow, and purple at that time. He is also described as black, 17- to 20-years-old, 5-foot-7 to 5-foot-9, about 165 pounds with black hair and brown eyes.

Authorities said that they were using all their means to arrest the suspect at all costs.

SANTA ANA, California – Two people, a man and a woman  were now under the custody of Santa Ana police, as the main suspects of murder in connection to a robbery-killing of a gambler, on his way home after a winning night at Hawaiian Gardens casino.

A third suspect who looks for the victim, Chi Ngoc Bui, won thousands of dollars inside the casino, was the whistle blower to the couple; that the victim would be an ideal robbery target, is now the subject of police manhunt, Cpl Anthony Bertagna of Santa Ana Police said.

Tad Carroll, 41, and Barbara Hamel, 47, of Long Beach, were in a 2001 Pontiac when they allegedly cut off Bui while driving with a female passenger on September 3 in Santa Ana, police said.

Bui struggled against Carroll on the pavement when the latter allegedly drew a knife. A $20 bills came flying out of Bui’s pocket during the scuffle.

Police said Carroll then got back into the Pontiac, where Hamel was behind the wheel, and she allegedly proceeded to run over Bui.

Bertagna said investigators have already identified the third suspect and believed they will capture him soon.

Miami, Florida – Joe Losada and Daniel Fernandez were guilty of felonies, jurors decided Wednesday. The two were ex-Miami-Dade police detectives, were immediately jailed to await sentencing.

“We respect the voice of the jury. It was a courageous decision,” Miami-Dade Assistant State Attorney Bill Altfield said. “They sent a message that this community will not tolerate corrupt police officers who violate the law.”

Undercover sting caught the men pocketing $970 part in marked bills. It was planted at a supposed crime scene inside a North Miami-Dade house in 2006.

Losada, 37, guilty of official misconduct, aggravated assault with firearm, misdemeanor battery and criminal mischief, faces at least three (3) years in prison. While Fernanandez, 58, was cleared of official misconduct, was convicted of burglary of an unoccupied dwelling for breaking back into the house where the alleged rip-off took place, jurors found.

The two however, were acquitted of false imprisonment and grand theft. Both were members of Miami-Dade’s Crime Suppression Team, a plainclothes unit that targeted drug dealers in the crime-plagued Northside district.

Informants of the crime were Pedro Soler, is a convicted drug dealer. The other, Rafael Rodriguez, is Soler’s acquaintance.

Defense attorneys Douglas Hartman and Richard Sharpstein, believed that their clients been set up by overzealous internal affairs investigators, relying on the words of crooks. “We’re stunned. Complete and utter disbelief that a jury would give one shred of credibility to a drug dealer who admits he continues peddling crack on the street,” said Sharpstein, Losada’s lawyer, during the two week trial.

Losada and Fernandez rejected a deal that absolved them of criminal charges in exchange for relinquishing their police certification. Now, they are convicted felons.
Miami-Dade State Attorney Katherine Fernández Rundle welcomed the police department’s Professional Compliance Bureau, better known as Internal Affairs.

After Wednesday’s verdict, “I want to congratulate the police detectives for their commitment to remove two corrupt officers from their department and commend the jurors for their courage to hold them accountable,” she said.

Losada is facing a separate trial for allegedly stealing a rifle in 2005 during his police work.
Fernandez fell ill after the verdict and paramedics were called, Hartman said.

CATLETTSBURG, Kentucky — Four local residents were indicted by Boyd County jury for allegedly burglarizing a number of local businesses.

Named in the charged sheets according to Boyd Commonwealth’s Attorney David Justice, were David M. Baldridge, 26, and Donald R. Nullins, 38, both of Ashland. Each one was charged 13 counts of burglary.
The other two were Christina Lynn Perkins, 41, of Flatwoods, and Kendra N. Taylor, 23, of Ashland, each on six counts of burglary.

The four confessed to being involved in a string of business break-ins. Victimized included Rich Oil on U.S. 60 at Summit, BP on Ky. 3, Rich Oil on Wheatley Road in Westwood, Air Equipment Sales & Service on Armco Road, Ferguson Plumbing on West Central Avenue, Mid-American Group on U.S. 60 and Exxon Tiger Mart on U.S. 60 at Canonsburg, according to the Boyd County Sheriff’s Department.
Amounting to several thousand dollars’ worth of cigarettes was stolen in the convenience store burglaries, while copper and tools were taken from Ferguson’s and Air Equipment. Some of the copper was recovered at a recycling center in the Huntington area, the sheriff’s department said.

A grand jury indictment is just a formal accusation of a crime and does not establish guilt.

TAMPA, Florida – Tampa Fire Rescue says a West Tampa man drove his truck a short distance from his house, set it on fire and tried to collect insurance money.

Detectives arrested 26-year-old Juan Santallana. He’s charged with second degree arson and insurance fraud.

Tampa Fire Rescue says back on the night of June 23, firefighters extinquished his truck. The 2009 Toyota Tacoma was on fire in an alleyway near the corner of Tampania and W. Green Streets. Santallana lives on W. Green Street a short distance away.

After a few weeks of investigating, Santallana was arrested on the morning of Thursday, July 15.

HOUSTON, Texas – A woman who operated two Houston companies must serve four years in prison over what prosecutors say was a $3.9 million motorized wheelchair scam.

Prosecutors say 46-year-old Sandra Thurman Patino surrendered Tuesday, as ordered by the court.

U.S. District Judge Lynn Hughes on Monday sentenced Patino and barred her, during three years of supervised release following her prison term, from seeking employment with any company that bills Medicare or Medicaid.

Investigators say fraudulent billing involving durable medical equipment, mainly motorized wheelchairs and accessories, ordered between 2002 and 2003 at a certain price, but less expensive equipment was delivered.
